Sales Terms & Conditions:
-By using this website to place an order and/or by receiving an order confirmation for review or approval, the customer agrees to all terms and conditions of sale. This agreement includes all the policies described below as well as the understandings and agreements listed prior to check out.
-All product specifications, terms, and prices are subject to change without prior notice.
-Shipping, handling, and insurance costs are NOT included in the product pricing.
-Custom made parts (made by DMI) and Special ordered parts (From other manufacturers) require 100% advance.
-ALL custom made and special order parts are NON-REFUNDABLE OR RETURNABLE.
-Any changes or alterations to an order that has been processed on the website or confirmed by email cannot be made verbally and should be submitted in written form. Written forms should be fax or email correspondence. Under no conditions will verbal changes be accepted.
-Dutchman will not be held liable for any complications or mistakes that arise from an unconfirmed order or desired change that was not submitted in writing.
-Dutchman may make special considerations that are not outlined in these terms and conditions, at its own discretion to correct any discrepancy or dispute.
-Dutchman will make every attempt to rectify any situation that arises from the purchase of a part manufactured by Dutchman axles and that falls within these published terms of sale.
-We require a web store shopping cart purchase or filled out order form for ALL custom "made to order" axle shafts & rear ends [NO verbal orders].
[This also includes any changes made to your custom order. A hard copy of what you want is for your protection and ours, and ensures a correct order the first time]
-Order desk hours are 7:30 am to 12:00pm & 1:00pm - 4:30pm, Monday through Friday, Mountain time. We are closed at lunch time and on most regular holidays. Orders by our web store or fax will be received 24 hours, 7 days a week.

Payment Terms:
-We accept cash, certified funds, cashier’s checks, money orders, bank checks, Visa, Master Card, and Discover.
-Credit card orders will be sent to the billing address of the card holder only.
-COD’s are upon approval only and require payment by certified funds, cashier check, money order, or bank check. (UPS no longer accepts cash).
-Personal or Company checks accepted on established pre-approved customers, and on new or one time customers, only if we have enough time to allow the check to clear the bank. Allow 2-3 weeks for this depending on your location in relation to us.
-Unless restricted by law, we will ship to foreign customers. Full order price plus shipping and handling (In US dollars) must accompany the order. No COD’s, credit cards, or checks.
-Charge backs require any component or part that is under dispute to be returned. Be advised, No charge back will be approved without the returned product.
-Dutchman will not be liable for any shipping costs, loss of time, missed races/events, costs from vehicles sitting at a shop, tying up a lift, or any other situation that exists and falls outside of Dutchman’s liability as outlined in these terms and conditions or that is deemed unreasonable.

Back Orders:
-Backorders will be shipped when the item(s) become available.
-You MUST advise us in writing if backordered parts are no longer wanted.
-We will confirm by phone or email prior to shipping.

Shortage Claims:
-Claims for shortages must be made to DMI within (5) days of receipt. This is ONLY if the parcel(s) were not damaged by the shipper, resulting in the lost parts.
-Any shortage claims must be proven by the consumer if Dutchman deems it necessary.
-Shortage claims will be fulfilled by Dutchman under the original terms of sale as indicated on the order confirmation or provided invoice.
-Dutchman will not be liable for any shipping costs, loss of time, missed races/events, costs from vehicles sitting at a shop, tying up a lift, etc. that arise from shortages and fall outside of these published terms.
-Dutchman will provide at no cost to the consumer, any parts or components that were involved in a confirmed shortage. Transit rate will be ground.
-Claims for dimensional deficiencies must be made within (15) days of the invoice date.
-Any dimensional deficiency must be proven by the consumer if Dutchman deems it necessary.
-Dutchman will correct at no cost to the consumer, any confirmed dimensional deficiency or error that exists if Dutchman deems it necessary to do so, in order for the product to provide proper function. Transit rate will be ground.
-Dutchman will not be held liable for any situations that arise from dimensional deficiencies that fall outside of these published terms.

Return Policy:
-No returns on custom made or special order parts.
-No returns accepted without prior authorization.
-Stock replacement axle shafts are custom made to order and the return of said product is subject to review and will be based on application rarity.
-Dutchman will make every attempt to rectify any situation that arises from the purchase of a part manufactured by Dutchman axles and that falls within these published terms of sale.
-Stock items returned MUST be un-used and in “new” sellable condition. Any item that has been installed will not receive credit. This includes partial installations.
-All refunds are subject to inspection of the item(s).
-Include a complete explanation of why you are returning the item and a copy of your original invoice.
-All Returns before 60 days will be subject to a 25% restocking fee. Returns after 60 days will be granted an in store credit only less a 25% restocking fee.
-Returns MUST be shipped “Freight prepaid” by the customer (NO incoming COD’s are accepted).
-Claims for dimensional deficiencies must be made within (15) days of the invoice date.
-Regardless of circumstances, items over 6 months are not returnable. DMI feels this is adequate time for decision making and to verify fitment.

Shipping Policy:
-All sales are F.O.B. Our plant in Meridian, Idaho & we use UPS for most normal sized parcels up to 150 lbs.
-We will use Truck Freight or Burlington Air for oversize and shipments greater than 150 lbs.
-All orders are sent by the most dependable and economical method that will insure them.
-All non COD parcels sent by UPS receive an “Adult Signature Required” sticker on the box. This should prevent UPS from leaving your order on your front porch, thus making it a theft risk. This is for your protection as YOU will be responsible if a theft occurs.

Damage Claims:
-Inspect your parcel upon receipt in the presence of the delivery person.
-If you notice damage to the parcel, have the delivery person take notice. Do not discard any of the damaged box, packing material, or broken parts.
-Take pictures for proof
-Claims for damages in shipping (Open or sealed) must be made to the shipper.
-Call UPS @ (800) 742-5877 or get the claim phone number from the delivery person if your parcel was sent by other means.

Warranty:
Merchandise is warranted free from defects in materials and workmanship. Liability is limited to repair or replacement. This warranty does not apply to any product which has been repaired or altered in anyway, so as in our judgment affects its performance, or any product that has been subject to misuse, abuse, negligence or any other occurrence beyond the control of DUTCHMAN MOTORSPORTS, INC. Modification of your vehicle’s chassis, suspension, or driveline to enhance the performance with the components listed in this catalog may create a dangerous condition which could cause serious bodily injury, and the buyer hereby expressly assumes all risks associated with any such modifications. In no event will DUTCHMAN MOTORSPORTS, INC. be held liable for damages including but not limited to down time, lost profits or revenue, goodwill, damage to or replacement of equipment and property, towing fees, loss of use or cost of substituted products, monetary compensation or any liability outside the published parameters of the warranty policy. Dutchman shall not be liable for any agreements or representations made by dealers or resellers of Dutchman products beyond what is stated here. Under no circumstances will DUTCHMAN MOTORSPORTS, INC. be held responsible for incidental or consequential damages arising from or in connection with the installation, use or misuse of any DUTCHMAN MOTORSPORTS, INC. product.
This limited warranty and conditions of sale shall be governed by and construed in accordance with the laws of the State of Idaho. Any legal actions which may arise as a result of disputes, controversies, or claims arising out of or related to this limited warranty and conditions of sale shall be litigated in the Court of Common Pleas of Ada County, Idaho.
